    General Terms and Conditions (GTC) – view beyond limits

    1) Scope and Conclusion of Contract

    These General Terms and Conditions (GTC) of beyond limits GmbH, Seehaldenstrasse 73, 8800 Thalwil (hereinafter "beyond limits") apply to all purchase agreements with private and business customers concluded via the website www.viewbeyondlimits.ch or by other means (e.g. email or telephone).

    The presentation of products in the online shop does not constitute a legally binding offer. By submitting the order, you place a binding offer. A legally valid contract is concluded upon order confirmation by beyond limits.

    2) Scope of Application – Intellectual Property and Other Rights

    The website www.viewbeyondlimits.ch is the official online portal of beyond limits (brand view beyond limits) and serves to inform customers. beyond limits may engage third parties for the operation of the portal. The following information and rules of use apply mutatis mutandis to content that customers receive, for example, in the form of newsletters or other digital communication means. All content, trademarks, designs, in-house developments, and other intellectually protected elements published on the website are the property of beyond limits or are licensed accordingly. Use, reproduction, or dissemination is permitted only with the express consent of beyond limits.

    3) Pricing and Validity

    The prices in the view beyond limits online shop are continuously updated and reflect the current status. beyond limits assumes no liability for incorrect pricing due to error. A purchase contract is only concluded upon order confirmation by beyond limits.

    All prices are in Swiss Francs (CHF) including statutory value-added tax. Time-limited offers are valid exclusively for the specified period.

    In addition to the stated product prices, shipping costs will be added depending on the order value. beyond limits will inform buyers of the specific shipping costs for each order during the order process.

    4) Availability and Conclusion of Contract

    beyond limits cannot guarantee the availability of the offered products. A contract is only concluded upon order confirmation by beyond limits. The products offered are stock items; should an ordered item unexpectedly not be (no longer) available, beyond limits will inform the buyers immediately and fully refund any purchase price already paid, unless an equivalent replacement item is desired.

    beyond limits assumes no liability for missed shipping or delivery dates. By placing an order, buyers are considered to have made a binding commitment.

    5) Delivery Date

    Delivery usually takes place within the period specified on the website or in the order confirmation. beyond limits is entitled to withdraw from the contract at any time, but only with simultaneous reimbursement of any purchase price or down payment already made.

    6) Transfer of Ownership and Passage of Benefit and Risk

    Benefit and risk pass to the buyers upon transfer of ownership.

    7) Payment Period and Accepted Payment Methods

    beyond limits accepts the following payment methods: credit card (Visa, Mastercard), PayPal, Twint, and prepayment/bank transfer.

    For payments by credit card, PayPal, or Twint, the purchase price will be debited immediately upon completion of the order; the order will be processed promptly after receipt of payment.

    For payments by prepayment/bank transfer, the entire purchase price is due upon conclusion of the contract (100% prepayment). Order processing will only begin after receipt of payment. The corresponding invoice must be paid net within 14 days. This deadline is binding for the buyers.

    8) Dunning and Collection Fees

    In the event of default in payment for prepayment/invoice payments (section 7), beyond limits is entitled, from the 2nd reminder, to charge reminder fees of 5% of the invoice amount. Default interest on overdue payments is due in accordance with the provisions of the Swiss Code of Obligations.

    9) Prices, Retention of Title

    beyond limits strives to offer stable prices but expressly reserves the right to change prices. The delivered goods remain the property of beyond limits until full payment. beyond limits reserves the right to register a retention of title in the retention of title register at the buyer's place of residence at its own discretion to secure the transfer of ownership until the purchase price is paid in full.

    10) Shipping Abroad

    beyond limits generally does not ship goods abroad – with the exception of Liechtenstein. Orders with a billing or delivery address outside Switzerland or Liechtenstein cannot be processed.

    11) No Right of Withdrawal / Exchange Right

    As purchases made through the view beyond limits online shop do not constitute a contract concluded outside business premises in the sense of consumer protection regulations with a statutory right of withdrawal, there is no statutory or contractual right of withdrawal or revocation for buyers.

    However, beyond limits, as a gesture of goodwill, grants buyers with a residential or billing address in Switzerland or Liechtenstein the following voluntary exchange right:

    • The item can be exchanged within 14 days of receipt of the goods.
    • The item must be in unused and undamaged condition and in its original packaging, including all labels, tags, and accessories (e.g., case, cleaning cloth, packaging).
    • Exchange process: Please contact beyond limits before returning by email, stating the order number and the desired replacement item (model, color, or size). beyond limits will promptly get back to you with further steps.
    • The return shipping costs for the exchange are borne by the buyers; beyond limits covers the shipping of the replacement item.
    • If exchanging for an item with a higher price, the difference must be paid by the buyers; if the price is lower, the difference will be refunded to the original payment method.
    • If the desired replacement item is temporarily unavailable, the buyer will be informed and will receive the item as soon as it is available again; a refund is not possible in this case. If the item is definitively no longer available in the assortment, the purchase price will be fully refunded.
    • There is no right to a refund of the purchase price without simultaneous exchange; exceptions are the aforementioned cases and claims arising from the statutory warranty (see section 12).
    • The voluntary exchange right does not apply to custom-made products, personalized products (e.g., engravings), or promotional goods expressly marked as "excluded from exchange."

    The statutory warranty for defects (section 12) remains unaffected by this regulation.

    12) Warranty

    The warranty period is two years and begins with delivery. The buyer is obliged to inspect the purchased item upon receipt and to report any defects immediately. The warranty is limited to the right of rectification and reduction, a rescission is excluded.

    For the following circumstances, the warranty is completely excluded, or the following circumstances lead to the complete exclusion of any warranty obligation:

    • normal wear and tear (e.g., scratches on lenses/visors due to use)
    • improper use, storage, or transport, including damage due to extreme temperature exposure (e.g., leaving in a car/in the sun)
    • fall or impact damage as well as other mechanical damage
    • unauthorized repairs, technical modifications, or the installation/conversion of incompatible or non-original spare parts (e.g., lenses, straps, padding) without the manufacturer's consent
    • wear parts such as nose pads, straps, padding, hinges, etc.
    • consequential damages
    • improper care/cleaning, especially with unsuitable cleaning agents or utensils (observe care instructions!)

    Insofar as the manufacturer grants further guarantees, these can, of course, be asserted against the manufacturer. beyond limits undertakes to support customers in asserting such guarantees if necessary. For manufacturer warranties, the manufacturer's conditions apply, e.g., compliance with the points listed in the user manual.

    13) Further Provisions

    Claims for damages due to errors in illustrations, prices, and texts or due to delayed or undelivered shipments are strictly excluded. beyond limits is not liable for any failure or delay in its performance caused by an act, event, omission, or accident beyond its control.

    14) Limitation of Liability

    beyond limits is only liable for damages based on gross negligence or intent. Any further liability is excluded to the extent permitted by law.

    15) Delivery Conditions

    Delivery will be made according to the order confirmation.

    16) Data Protection

    17) Applicable Law and Place of Jurisdiction

    These General Terms and Conditions are exclusively governed by Swiss law, in particular the provisions of the Code of Obligations (OR). The United Nations Convention on Contracts for the International Sale of Goods (CISG) does not apply.

    The exclusive place of jurisdiction is Thalwil (ZH), Switzerland.

    18) Amendments to the GTC

    beyond limits reserves the right to amend these GTC at any time. The version of the GTC valid at the time of the order shall apply.
